Who is liable if the title of the car is under another name?

My brother accidentally backed up into someones car the other day. There wasn't any scratches present on either car. The owner of the other vehicle is trying to sue my dad or rather his insurance company. The problem is, my brother has his own insurance, and he doesn't even live with us any longer; but the title was still in my dad's name. Can they do that to my dad?
